


This offence is committed when the driving was without due care and attention or without reasonable consideration for other road users; the driving has caused the death of another person and the driver is either unfit through the consumption of drink or drugs, or the alcohol concentration in his body is over the prescribed legal limit, or there has been a failure to provide a specimen of breath/blood/urine in accordance with the Act’s procedures.
This can only be tried in the Crown Court
