Causing Death by Dangerous Driving

The offence is committed when the driving was the case of the death of another and it was dangerous within the meaning of the Act. The prosecution does not have to prove that the death was foreseeable. It needs only to prove that the vehicle was being driven dangerously and that this driving was the cause of death.

It can only be tried in the Crown Court.

Maximum penalty: 

Up to 14 years imprisonment
Unlimited fine
Compulsory disqualification of at least 2 years plus a retest
