Causing Death by Driving Unlicenced, Uninsured or Disqualified

This offence is yet to come into force, but it will be committed when a driver causes the death of another person by driving on a road when unlicenced or uninsured, or disqualified from holding or obtaining a driving licence. The nature and quality of the driving will be irrelevant.

The offence will be tried in either a Magistrates’ Court or the Crown Court.

Maximum penalty: 

Fine up to £5,000 or up to 6 months imprisonment or both in a Magistrates’ Court
Up to 2 years imprisonment or fine or both in the Crown Court
Compulsory disqualification
